Can I possess a firearm while on parole or probation?

In North Dakota, individuals on parole or probation cannot own or possess a firearm. According to North Dakota Century Code, it is illegal for any person convicted of a felony to possess a gun unless otherwise restored by a court. This applies to any person who is on parole, probation, or any other type of release from prison. The only exception is for those individuals on parole or probation in North Dakota if they received permission from their parole or probation officer. The individual may also need to receive confirmation from the Bureau of Criminal Investigation or the state’s Attorney. Even with permission, the individual must still follow all other state and federal firearm laws. Also, any parolee or probationer who is a prohibited possessor cannot be in an area where firearms are kept, such as a gun shop or gun show. Even if the gun is not intended for their personal use, it is still a violation of the law. In short, it is illegal for a person on parole or probation in North Dakota to possess a firearm. If an individual needs permission to do so, they must contact their parole or probation officer and possibly the Bureau of Criminal Investigation or the state’s Attorney.
