A probation revocation hearing is held when a person on probation is accused of violating the terms of their probation. If the allegations are proven to be true, the probationer’s probation may be revoked and they may be sentenced to jail or prison for a certain amount of time. In both cases, the accused individual is typically offered a hearing in which they can present evidence of their compliance with the terms of their parole or probation. The state will present evidence as to why the accused should be found in violation and both sides will be able to comment. After both sides have presented their cases, the judge will make a decision as to whether the accused has violated the terms of their parole or probation and take whatever action is appropriate.
