Who will decide if I am guilty of violating parole or probation?

The court will decide whether you are guilty of violating your parole or probation. Generally, a parole or probation violation occurs when an offender fails to abide by the rules set by the court. It could be something like missing a meeting with probation officer, testing positive for drugs, or committing another crime. In Michigan, when an offender is suspected of violating the conditions of probation or parole, a court hearing will be held. The judge will examine the evidence presented by the prosecutor, such as police reports and witness testimony, and decide if the parole or probation violation has occurred. If so, the judge will then decide what sentence the accused should receive depending on the seriousness of the violation. Before making an official decision, the judge may also give the offender an opportunity to explain why they should not be held accountable or why their sentence should not be increased.
