What happens if I am found guilty of violating parole or probation?
If you are found guilty of violating parole or probation in Minnesota, the consequences depend on the severity of the violation and the judge’s decision. Common sanctions for a parole violation can include a warning, additional or stricter parole conditions, or revocation of parole and a return to prison for the remainder of the sentence. For probation violations, additional sanctions can include restitution, community service, an extension of the probationary period, or even jail time. In Minnesota, all offenders who are found guilty are given an opportunity to be heard by a judge and explain any extenuating circumstances that could have caused them to break the rules. If you are found guilty of violating parole or probation and are deemed to be a danger to the community, the state of Minnesota might decide to revoke your release and put you back in prison for the remainder of your sentence. In some cases, a judge may decide to sentence the offender to an even longer prison term after a review of the offender’s criminal history and the extent of the violation.
