How do I contest a paternity test result?

In Maine, disputing a paternity test result can be done through a legal process known as a paternity action. The process begins with filing a Complaint to Establish Paternity in court. This must be done by the mother, father, child, or the Department of Health and Human Services. Once the Complaint is filed, the parties can ask the court to order a DNA test. If the test shows that the man is not the biological father, the court will issue an Order of Nonsuit. This order terminates the court proceeding without any decision being made. If the DNA test shows that the man is the biological father, the court will issue an Order of Filiation. This order legally establishes him as the father and requires him to pay child support and/or provide medical insurance. The Order of Filiation can be challenged, however.
