What is a paternity suit?
A paternity suit is a legal action brought in court by a mother or possible father to establish the paternity of a child. In Nebraska, paternity law dictates that a man who is legally determined to be the father of a child will be responsible for providing support for that child. Paternity suits are often necessary to establish the legal rights of a child and to ensure the father is responsible for financial support. Generally, paternity suits are initiated by the mother of the child, who will ask the court to establish the legal father of the child. The court may then order a DNA test to confirm the identity of the biological father. If a man denies being the father of a child, the court may require the mother to seek a paternity suit against him, to provide evidence of the father’s identity. In some cases, a man may initiate a paternity suit against a mother to prove he is the legal father of a child. In other cases, a third-party may also initiate a paternity suit, in order to establish the paternity of a child in a family law dispute or to seek financial support from the father of a child. No matter who initiates the paternity suit, it is important that the suit is brought before a court, as the decisions made by the court have a long-term legal impact on the child and the parent’s rights and responsibilities.
