What is the definition of a pedestrian accident?
A pedestrian accident is a type of motor vehicle collision involving a pedestrian. Pedestrian accidents can occur in a variety of ways, such as when a driver fails to yield to a pedestrian in a crosswalk, when a driver swerves to avoid hitting an animal and hits a pedestrian instead, or when a driver simply doesn’t see a pedestrian in the area. In California, pedestrian accidents are governed by California Vehicle Code sections 21950-21969. These sections define a pedestrian as “any person afoot” and include a variety of rules that must be followed to keep pedestrians safe. For example, drivers must yield the right-of-way to pedestrians in a crosswalk and must not drive at a speed that endangers or unreasonably interferes with the safety of any pedestrian. Additionally, drivers must exercise “due care” for the safety of any pedestrian and must take necessary precautions to avoid a collision. If a driver does not follow these rules and causes an accident involving a pedestrian, they can be held liable for any injuries or damages suffered by the pedestrian.
