What is the difference between a breach of professional liability law and a breach of trust?
A breach of professional liability law is when a professional either fails to provide services that they are legally obligated to, or provides services that are below the standard of care for their profession. This is usually due to negligence or a failure to abide by a code of conduct. A breach of trust is when a professional violates the trust that their client has placed in them for the purpose of providing services. This typically involves deception, fraud, or a misuse of the client’s information. In North Carolina, both breaches of professional liability law and breaches of trust can result in civil or criminal penalties, depending on the severity of the breach and other factors. These penalties may include monetary restitution, censure or suspension of licensure, or even jail time if the breach is serious enough. In addition, affected individuals may be able to bring a civil claim against a professional who they feel has committed a breach of trust or liability law.
