What is the difference between professional negligence and ordinary negligence?
The main difference between professional negligence and ordinary negligence is the standard of care. Professional negligence involves a higher standard of care because professionals are expected to possess a certain level of expertise within their field of practice. In North Carolina, professional negligence occurs when a professional fails to provide a duty of care which is the same as or close to the standard of care provided by another similarly situated professional in similar circumstances. Ordinary negligence, on the other hand, is when an individual fails to exercise the same degree of care that a reasonable person would exercise in similar circumstances. In North Carolina, the standard for ordinary negligence is a reasonable person and making sure that an individual does not create a foreseeable risk of harm to another person. The consequences for professional negligence are more severe than ordinary negligence because of the higher standard of care. A professional who is found liable for professional negligence can be subject to disciplinary action, including the revoking of their license to practice. They may also be sued in civil court for damages, including medical bills, loss of wages, or even pain and suffering. Ordinary negligence typically only results in a financial penalty, as the individual is responsible for compensating the injured party and for any damages.
