Are there any laws regarding reimbursement for prescription drugs?

In Virginia, there are laws and regulations in place regarding reimbursement for prescription drugs. According to the Virginia Pharmacists Association, pharmacies must be paid at least the amount of the Minimum Acquisition Cost (MAC) for any drug covered under the Virginia Prescription Drug Program (VPDP). The MAC is the amount that pharmacies are reimbursed for generic drugs and certain brand-name drugs purchased through the state-run VPDP. In addition, the Virginia Pharmacists Association also provides financial assistance to pharmacies that are unable to obtain reimbursement of the MAC from health insurers for certain prescription drugs. Eligible pharmacies may receive financial assistance to cover the difference between the amount the insurer pays and the MAC. Finally, pharmacies in Virginia are required to charge no more than the MAC for generic drugs and certain brand-name drugs purchased through the VPDP program. Pharmacies are also required to pay the remainder of the amount not reimbursed by the insurer to the patient or other third-party payer. Overall, Virginia has laws and regulations in place regarding reimbursement for prescription drugs, including the requirement to be reimbursed at least the MAC for drugs purchased through the VPDP program as well as financial assistance to pharmacies unable to obtain full reimbursement for certain prescription drugs. Lastly, pharmacies are required to charge no more than the MAC and to pay the remainder of the amount not reimbursed by the insurer to the patient or other third-party payer.
