What are the requirements for complying with PIPEDA?
PIPEDA, or the Personal Information Protection and Electronic Documents Act, is a privacy law in Canada that also applies to organizations operating in Washington that are collecting, using, or disclosing personal information of customers in Canada. The purpose of PIPEDA is to protect the privacy of an individual’s personal information while enabling organizations to use that information in the course of their business. In order to comply with PIPEDA, organizations must obtain the individual’s consent when collecting, using, or disclosing their personal information, unless the organization can demonstrate that it is necessary to do so without their knowledge. Organizations also must maintain safeguards for the protection of the personal information that they possess, and inform individuals of the purposes for which their information is used, as well as how it is shared with third parties. In addition, organizations must allow individuals access to their information collected, if requested, and give individuals the opportunity to correct any errors in their information. Lastly, organizations must also make sure they dispose of any personal information they have in a secure manner. By following these requirements, organizations in Washington that are operating in Canada will be complying with PIPEDA and protecting individual’s personal information.
