How are data privacy rights enforced?
Data privacy rights in Virginia are enforced in a variety of ways. The Virginia Freedom of Information Act (VFOIA) was signed into law in 1968 and was amended numerous times since then to protect personal and business data. Under VFOIA, individuals may request access to government records and have the right to know how their data is being used. Additionally, Virginia has numerous privacy statutes that allow individuals to take action in the event of a data breach or unauthorized access to their data. For example, Virginia’s Data Breach Notification Act requires businesses to provide notice of a data breach. Additionally, the Virginia Consumer Protection Act prohibits businesses from collecting or using consumer data without their consent. There are also criminal offenses that can be prosecuted under state and federal law for those that violate data privacy rights. These include unauthorized access to computer systems, interception of communications, and other forms of fraud and identity theft. Finally, individuals can bring civil lawsuits against those who unlawfully access or misuse their personal information. In Virginia, individuals may be entitled to damages for emotional distress, mental anguish, or even punitive damages if the court finds that the violation was intentional.
