What is a “manufacturing defect”?

A manufacturing defect is a type of liability in a product that is solely the fault of the manufacturer. In Virginia, a manufacturing defect is a product that departs from its intended design, deviates from manufacturing specifications, or is defective in a way that renders it unreasonably dangerous for use. When a manufacturer produces a product with a defect, they can be held liable for the product and any resulting damages or injuries. To prove that a manufacturer was liable for the defect, plaintiffs in Virginia must show that the product was defective when it left the factory and that the product was used in a way that was consistent with its intended use. Manufacturing defects can occur in many ways and are often a result of negligence by the manufacturer. Manufacturing defects can be the result of the manufacturer failing to use the proper materials, failing to follow their manufacturing specifications, or failing to adequately inspect the product for defects. In Virginia, the burden is on the plaintiff to prove that the product was defectively manufactured. This can be difficult, but it is essential in order to hold the manufacturer accountable and to receive damages for any resulting injuries or damages.
