What role does a “defect in the manufacturing process” play in product liability claims?

In South Carolina, a defect in the manufacturing process can play a major role in product liability claims. When a consumer uses a product, they assume the product is safe and free from any defects. When a defect is discovered in the manufacturing process, the consumer is able then to hold the manufacturer responsible for any harm the consumer suffered due to the defect. In South Carolina, there are three primary types of defects in the manufacturing process that can lead to a product liability claim. These include a design defect, a manufacturing defect, and a failure to warn. A design defect is when the product was designed in an unsafe manner, a manufacturing defect is when the product was assembled with an unsafe component or part, and a failure to warn is when the manufacturer of the product fails to provide adequate warnings about possible risks associated with the product’s use. In order to prove a product is defective, the consumer must show that the product was unreasonably dangerous as a result of the defect. This means, that the product was not reasonably safe for its intended purpose. The consumer must also show that the defect is the cause of any harm they suffered from using the product. If the consumer can prove a defect in the manufacturing process was the cause of harm, the consumer is then able to hold the manufacturer accountable for the harms the consumer suffered. The manufacturer is then liable to the consumer for the costs of any harm, including medical bills, lost wages, and other damages.
