What is a “negligence claim”?

A negligence claim is a type of legal action based on the idea that someone has failed to act in a way that a reasonable person would in a similar situation. In Virginia, negligence claims are often associated with products liability law. This means that a person can sue a party (usually a manufacturer) if they have been injured due to a defective product. To file a successful negligence claim, the plaintiff must prove that the party being sued was indeed negligent. This means that they acted in a manner that was careless, and did not take the proper safety precautions or use due care in the situation. The burden of proof for this rests on the plaintiff, who must provide evidence to show that the defendant was indeed negligent. If the plaintiff can prove that the defendant was negligent and caused the injury, then the court may award compensatory damages. These damages are intended to restore the plaintiff to the same financial position they would have been in had the injury not occurred. Punitive damages may also be awarded if the court finds that the defendant’s actions were especially egregious. In summary, a negligence claim is a type of legal action in which a person can sue a party for damages caused by their carelessness. In Virginia, persons injured by defective products may qualify for a negligence claim. The plaintiff must prove that the defendant was negligent, and if successful, may be awarded compensatory and/or punitive damages.
