What are the damages that a plaintiff can recover in a product liability case?

In an Oregon product liability case, a plaintiff is entitled to recover damages they have suffered as a result of a defective product. These damages are typically categorized as economic or non-economic damages. Economic damages are those that have a dollar amount associated with them, such as medical bills, lost wages, and property damages. Non-economic damages are for intangible losses, such as pain and suffering, emotional distress, and loss of reputation. In Oregon, a plaintiff is also able to recover punitive damages in a product liability case. Punitive damages are intended to punish the product manufacturer for their actions and are awarded in addition to compensatory damages. The purpose of punitive damages is to deter future wrongdoings. In addition to damages, a plaintiff may also be able to recover attorney’s fees, expenses, and court costs. These are intended to reimburse the plaintiff for having to pursue justice through the court system. To be successful in a product liability case, the plaintiff must be able to prove that a product is defective and that the product caused their injuries. Doing so can be difficult as many product manufacturers have experienced legal teams that will fight to have the case dismissed.
