What is a quiet title action?
A quiet title action is a type of lawsuit used in the state of Washington to determine the rightful owner of real estate property. This action must be filed in the Superior Court of Washington and it requests the court to determine who owns a particular piece of real estate. The purpose of a quiet title action is to resolve legal disputes between multiple parties over ownership of a particular piece of property. To file a quiet title action, one must first provide proof that they have a legal interest in the property. This can be done by providing a deed, mortgage, judgement, or tax lien. After filing the action, any other individuals with a legal interest in the property must be notified. They must then respond to the quiet title action within a certain period of time. The court will then examine all the evidence provided by each party, including any title searches and deed records, to determine who has the right to the property. If the court finds that one party’s claim is more valid than the others, it will issue a quiet title judgement. This judgement gives the rightful owner legal possession of the property and ends the dispute.
