What are the elements of a valid deed?
A valid deed in Kansas must contain several elements in order for it to be considered legally binding. First, it must contain the names of the grantor and grantee, or the person(s) transferring the property and the person(s) receiving the property. Second, it must contain a clear description of the property being transferred, including the location of the property. Third, it must include language that clearly expresses the transferor’s intention to legally transfer the property. Finally, it must be signed by the grantor and notarized in order to be legally binding. In addition, most deeds include a legal description of the property, as well as an acknowledgement from the grantor that they have the right to transfer the property. Other important information that can be included in a deed are the consideration (payment) received for the transfer and any encumbrances or limitations on the property. All of these elements must be present for the deed to be considered valid. In Kansas, a deed must also be filed with the county or district office in order to be considered legally binding.
