What is a deed of restrictive covenant?

A deed of restrictive covenant is a legal document that outlines certain restrictions imposed on a property in Virginia. This document is created when two parties transfer rights and interests in the property and one party imposes certain restrictions and/or obligations on the other. These restrictions are legally binding and enforceable in a court of law if the other party does not abide by them. Some common types of restrictions outlined in a deed of restrictive covenant include limiting the use of the property for certain purposes, such as commercial activities or residential dwellings. It can also restrict the types of activities which can take place on the property, including prohibiting the construction of certain buildings or structures. Additionally, restrictive covenants can limit what colors are used for the exterior of a building, or what types of changes can be made to the land, such as removing vegetation or cutting down trees. The purpose of a deed of restrictive covenant is to keep the property safe, healthy and attractive. It also provides control over how the property is used, so that the rights of all parties are respected, and helps protect the property from potentially negative changes that could reduce its value. Though restrictive covenants can be challenging to enforce, they are an important part of Virginia property law.
