What is a patent reexamination?

A patent reexamination is a procedure that a patent holder can use to challenge the validity of a patent that has already been granted. In Washington, it is granted by the US Patent and Trademark Office (USPTO). It is used to review the validity of the original patent filing and to determine if the patent should stand or be invalidated. The patent can be challenged on the grounds that the patent is not new or novel, that it doesn’t meet the criteria for patentability, or that it was already publicly disclosed before the application was filed. The process of patent reexamination starts with a request submitted to the USPTO. The request can be submitted either by the patent holder or by a third party. The request must include evidence that shows why the patent should be reexamined. After the request is filed, the USPTO will review the information and determine whether to proceed with the reexamination. If the USPTO agrees to reexamine the patent, the office will assign an examiner to review the evidence and review the original patent to determine whether the criteria for its validity have been met. If the examiner believes that the original patent is invalid or does not meet the criteria for patentability, he or she can recommend that the patent be revoked or amended. The patent holder then has the opportunity to respond to the examiner’s findings and make a counterargument. Once all parties have had the opportunity to present their case, the USPTO will render a decision. The decision could be to maintain the patent in its original form, modify it, or even invalidate it.
