What is the Patent Cooperation Treaty (PCT) system?

The Patent Cooperation Treaty (PCT) system is an international agreement that makes it easier and more efficient to obtain patents in multiple countries. The PCT system is managed by the World Intellectual Property Organization (WIPO) and allows an inventor to file a single application with several different countries instead of having to file separate applications with each country. Under the PCT, the applicant completes a single international patent application that is filed with the International Bureau (IB) at the WIPO. The IB reviews the application to make sure that it meets certain requirements and assigns an international filing date. The filing date is important, because it starts a one-year period during which the applicant must decide which countries to pursue a patent in. During this one-year period, the application is also made publicly available to interested parties. After the one-year period, the applicant then has the option to pursue individual patent applications in foreign countries. This process is more cost effective, as the applicant only has to pay one set of search and examination fees. Furthermore, the grant of the international patent application does not guarantee that the patent will be granted in all countries, as the applicant must still satisfy the requirements for grant of the patent in each individual country. Overall, the PCT system is a useful tool for inventors who wish to obtain patent protection in multiple countries. It is important to note, however, that the system does not replace the need to obtain separate patent applications in each country – instead, it simply allows applicants to simplify and streamline the international patent application process.
