How do I pay patent fees?

In South Dakota, the patent fees associated with filing and processing a patent application are paid directly to the U.S. Patent and Trademark Office (USPTO). The fees are based on the type of application you are filing and how many claims are included in your application. To pay the fees, the applicant should file a Form SF-270 with the USPTO. This form can either be submitted with the application or after the application is already on file with the USPTO. The most common type of fee is the “Basic Filing Fee”, which is paid in order to file the application. This fee can range from $420 for small applicants up to $1800 for large entities. Other fees include the “Claims Fees” and “Examination Fees”. The Claims Fees is charged for each claim in the application beyond 20, and the Examination Fees is used to cover the costs of the patent examiner examining the application. Depending on the type of application, additional fees may need to be paid as well. For example, if an application is a National Stage application, additional international application fees will be required. It is important to pay all fees associated with a patent application to ensure it is processed in a timely manner. Payment can be made by check or credit card and must be paid directly to the USPTO.
