What is a real estate title?
Real estate title is the legal document that proves who owns a piece of real estate. The title is typically held by the homeowner, but if the homeowner is unable to keep the title, it can be held by a bank or other lender that has provided a loan to the homeowner. The title includes information about the current owner and any liens or encumbrances that have been placed on the property. It also contains any easements that may exist on the property. A title search is the process by which the title is examined to make sure that the title is valid and that the owner actually owns the property. This is typically done by a title company that will do a detailed search to look for any unpaid mortgages, liens, or other claims against the property that would affect the title. When purchasing real estate, it is important to review the title before signing any transfer of ownership documents. This will ensure that the title is clear of any claims or liens and that the real estate is free and clear of any restrictions that may be placed on it. In some cases, a title insurance policy may be purchased to protect against any problems that may arise with the title. In Washington, real estate title laws are regulated by the Washington State Department of Financial Institutions. This department ensures that the title is properly recorded and that the title is accurate and up to date. The department also oversees the title search process and monitors the title insurance companies.
