What is a quiet title action?

A quiet title action is a type of lawsuit that deals with real estate in Washington. It is used to determine who owns property, or to resolve title disputes among multiple claimants. In a quiet title action, a court determines which person has the right to use, possess, and transfer the property. The primary purpose of a quiet title action is to provide legal “peace of mind” to a new property owner and to ensure that the property title is free from all disputes. By clearing the title, the new owner can be sure that they are the sole owner of the property and that they can use, possess, and transfer it as they wish. To begin a quiet title action, a complaint must be filed with the court. The complaint outlines the facts of the case and names all individuals with a claim to the property in question. Once the complaint is filed, the court will hold a hearing and the parties involved will present evidence to support their claims. Ultimately, a judge will make a decision regarding who has the right to use, possess, and transfer the property. When a court issues a decision in a quiet title action, it is binding and cannot be challenged in the future. This means that after a decision is made, the parties who have a claim to the property must abide by the court’s decision. A quiet title action provides legal certainty that the title of the property is clear and that the rightful owner is the sole owner of the property.
