What is the difference between a real estate lease and a rental agreement?

The main difference between a real estate lease and a rental agreement is the length of time that they cover. A real estate lease is a long-term agreement that is typically signed for a period of one year or more, while a rental agreement is usually a short-term agreement, covering a period of one month or less. Real estate leases also usually contain a provision known as “tenant obligations” that outline the tenant’s responsibilities when living in the property, such as paying rent on time and maintaining the property in accordance with the terms of the lease. Rental agreements usually contain few such provisions, as they are intended to cover a shorter period of time. In Virginia, real estate leases must be in writing and signed by both parties, and must meet certain legal requirements in order to be enforceable. Additionally, landlords must provide tenants with a copy of the lease within 21 days of signing and must begin collecting rent within 45 days of signing. Rental agreements, on the other hand, do not need to be in writing and are not subject to state laws; they may be enforced by the landlord or tenant depending on the agreement terms.
