What are the laws regarding franchising agreements?
In South Dakota, franchising agreements are regulated by the South Dakota Franchise Investment Law (SD Code Ann. Sections 37-4A-101 et seq.). This law covers any franchise agreement made in South Dakota that involves the sale of goods, services, or a business opportunity. Franchising agreements must be in writing, and need to contain certain key information, including the identity of the franchisor and franchisee, the terms of the agreement, the fee and payment structure, the products and services to be provided, and any additional restrictions or obligations.
