What is the process for resolving business disputes?
Business disputes can be resolved through the court system or through some alternative dispute resolution presented outside of court. In Virginia, businesses can choose between arbitration or mediation. Arbitration is a form of alternative dispute resolution in which a neutral third party, known as an arbitrator, is utilized to hear an argument and decide the outcome. The process is similar to court proceedings, but is usually quicker and less formal. The arbitrator will consider submissions from both parties and arrive at a decision. The parties involved in the dispute have the option to appeal the arbitrator’s decision in court. Mediation is another form of alternative dispute resolution that involves an impartial third party. The mediator assists the parties in resolving the dispute in an informal setting. In this process, the parties involved are given an opportunity to explain their side of the issue and to work toward a mutually agreeable solution. It is a voluntary process, and if the parties cannot reach an agreement, then the dispute must be resolved through the court system. No matter which method is chosen, resolving a business dispute can be a complex process. Business disputes can cost time and money, so it is important to understand the different forms of dispute resolution and to choose the best option for the situation.
