What are the laws and regulations pertaining to dispute resolution?
In Hawaii, small business owners must abide by certain laws and regulations when it comes to dispute resolution. The most important of these is the Hawaii Uniform Arbitration Act (HUAA), which allows for disputes to be taken to an independent third party for resolution. This form of dispute resolution is known as arbitration and can be much quicker and less expensive than taking a dispute to court. Another law pertaining to dispute resolution for small businesses in Hawaii is the Uniform Mediation Act (HUMA). This act establishes the process of voluntary mediation, which allows the parties involved to negotiate in confidence with the assistance of a neutral third party. The parties involved can agree to a settlement that works for them without having to go to court. The Small Business Regulatory Enforcement Fairness Act (SBREFA) is also important, as it requires federal agencies to work effectively with small businesses to reduce the burden of compliance with regulations and to address disputes and complaints in a timely and efficient manner. Finally, the Hawaii Small Business Regulatory Fairness Board provides small businesses with an independent body to review complaints regarding the enforcement of laws and regulations. The Board can provide advice and assistance to small businesses during disputes, as well as provide information and resources to help small businesses better understand the laws and regulations they must follow.
