How does small claims court handle appeals?

In Colorado, appeals in small claims court cases can be heard by the district court. The appeal process begins when a party that was dissatisfied with the outcome of the small claims court trial files an appeal with the district court. This must be done within fourteen calendar days of the court’s judgment in the trial. The district court will review the appeal and set a date for a hearing. During the hearing, the appellant has the right to present evidence, call witnesses, and cross-examine witnesses. The court will consider the evidence presented at the trial, as well as the new evidence presented at the appeals hearing. After the hearing, the court will issue a decision, which may be upheld, reversed, or modified. All parties have the right to appeal the district court’s decision to the court of appeals. The court of appeals may affirm, reverse, modify, or set aside the district court’s decision. If a party is not happy with the decision of the court of appeals, the party may ask the Colorado Supreme Court to review the case. The Colorado Supreme Court receives very few requests for review, and typically declines to hear appeals from small claims court cases. Therefore, the decision of the court of appeals is usually the final decision in a small claims court appeal.
