Within ten days of filing the Notice of Appeal, a “Record of the Appeal” must also be filed with the small claims court clerk. The Record of the Appeal includes the docket number, all documents related to the small claims court action, and a full transcript or audio recording of the trial. The appellant must also prepare a written brief that outlines the legal arguments why the small claims court decision should be reversed or modified. This brief is formally called a “Statement of the Case” and must be filed with the higher court within 35 days of filing the Notice of Appeal. The appellee will then be given an opportunity to respond with their own brief and the higher court may also ask for additional briefs from either party. Ultimately, the higher court will review the briefs and make a decision on the appeal. The higher court’s decision is final, so all decisions should be made carefully.
