How do I file an answer to a complaint filed in small claims court?
In Colorado, the process for filing an answer to a complaint filed in small claims court is relatively straightforward. Typically, you or your attorney will file a written document called an "Answer" which will contain your denials and defenses to the claims in the Complaint. This Answer should be filed with the court and served upon the plaintiff within 20 days of the date the Complaint was served on you. Your Answer must include all the information necessary to properly respond to the Complaint including any defenses you may have. The Answer should also include a request for a jury trial if you wish to have a jury trial. Once you have filed the Answer, the court will enter a Judgment based upon the allegations in the Complaint unless the plaintiff decides to amend the Complaint or withdraw it. Additionally, if your Answer is contested by the plaintiff, the court may hold a hearing so that each side can present their respective cases. It is important to keep in mind that if you fail to file an Answer within 20 days, you may be subject to a default judgment against you and the court may enter a judgment for the relief requested in the Complaint. Therefore, if you wish to protect your rights, you should file a timely Answer.
