How does small claims court handle appeals?

In South Carolina, appeals from small claims court are handled in the civil court system. An appeal is a request made by a party to a court to have a decision overturned. When a small claims court decision is appealed, the appellant is required to file a notice of appeal and pay the applicable filing fee. The notice of appeal is filed with the Clerk of Court in the county where the small claims case was decided. The appellant must then serve the other parties to the small claims case with the notice of appeal. After the notice of appeal is filed and served, the small claims case is transferred to the civil court system. In civil court, the parties must produce evidence in support of their claims and a judge will review the case and make a ruling. The parties have the right to appeal the ruling of the civil court judge as well. In South Carolina, appeals from the civil court are heard by the South Carolina Court of Appeals. The Court of Appeals will review the evidence presented and may uphold or overturn the lower court’s decision. If the case is heard by the South Carolina Supreme Court, the justices will review the evidence as well and may uphold or overturn the lower court’s decision. Because appeals from small claims court are heard in civil court, it is important that all parties involved understand the procedure and requirements for appealing a small claims court decision. Appeals can be a long and costly process; therefore, parties should consider if an appeal is the best course of action for their situation.
