How do I file an answer to a complaint filed in small claims court?
If you have been served a complaint in small claims court in Maryland and would like to respond to the complaint, you will have to file an answer. To do this, you must go to the court in which the complaint was filed and pick up a form for an answer or counterclaim. You must file your answer within 30 days of the service of the complaint. Once you have filled out the answer form, you must make three copies of the form; keep one copy for yourself, one to send to the other side, and one to give to the court. The form should include explanations for why you disagree with the plaintiff’s complaint. Once you have completed the form, you must sign it in front of a notary public. After the form is signed, you must give one copy to the court, one to the other side, and keep one for yourself. When you submit the form to the court, you must also pay a filing fee. The fee can vary depending on the county and the amount sought in the complaint. Once the court has received your answer, the plaintiff and you will have to attend a hearing before a judge. At the hearing, the judge will listen to both sides and decide the outcome of the dispute.
