How do I request a stay of proceedings in small claims court?

In order to request a stay of proceedings in small claims court in North Carolina, you must fill out a form called a Request for Stay of Proceedings. This form can be found on the North Carolina Courts website and must be printed, filled out, and filed with the court. The form must include certain information, including your name, address, and phone number; the case number, if available; a brief description of the case; and the reasons you are requesting the stay of proceedings. You must also provide a proposed timeline for when the stay should come into effect. Once the form is completed, you must make two copies of the form and file them with the court clerk. Then you must provide the other party with a copy of the form as well, either in person or by mail, with a tracking number. If the court grants the stay of proceedings, it will provide the two parties with a date when the case will resume. Until that time, the case will be put on hold. If the stay is denied, the other party may file an objection with the court. If the court denies the objection, the case will proceed as scheduled.
