What is the process for requesting a court trial in a small claims court case?
In Colorado, if you wish to request a court trial in a small claims court case, you must first file a Complaint with the court. This complaint outlines the reason for your case and requests that a court hearing be held. Once the Complaint is filed, the court is required to schedule a hearing date within 45 days. The court will also send a copy of the Complaint to the other party in the case, who must respond within 20 days. At the court hearing, both parties will have the opportunity to present their arguments in front of a judge. If either party wishes to introduce evidence to support their arguments, they must do so at this time. After both parties have presented their cases, the judge will issue a ruling. This ruling is legally binding and cannot be appealed. If you have any questions or need assistance in filing a Complaint, you can contact the small claims court clerk or consult with an attorney. Additionally, the court may offer free or low-cost mediation services if both parties agree to it. This can provide an opportunity to resolve the dispute without going to court.
