How do I collect a small claims court judgment from a business?

If you have been successful in receiving a small claims judgement from a business in Colorado, collecting the funds can prove to be the more difficult process. The first step is for the clerk to issue a Writ of Execution to a county sheriff or constable, who will contact the business to collect on the judgement. If the sheriff or constable is able to collect the funds as per the Writ of Execution, then payment will be distributed to the court for you to collect. If the sheriff or constable is unable to collect on the Writ of Execution, then the court fee for filing a lien against the business and its assets can then be paid. Once paid, a Notice of Lien will be sent to the Colorado Secretary of State’s office, who will then record the lien in the county and state where the business is located. The lien will stay in effect until the judgement is satisfied. It is also possible to file a Writ of Garnishment with the court, which authorizes a bank or employer to pay money directly to you, as opposed to the business. In order to do so, the business must be notified of the Writ. The court may also issue a Writ of Execution to seize and sell property belonging to the business in order to satisfy the judgement.
