When is the plaintiff's evidence due in a small claims court hearing?
In Washington, the plaintiff’s evidence must be provided to the court before the small claims court hearing begins. According to Washington State law, the plaintiff must provide their evidence within 3 days of the hearing date. Upon receipt of the plaintiff’s evidence, the defendant has 3 days to provide their evidence in response. At the hearing, the plaintiff is allowed to present their evidence first. The court requires the plaintiff to provide all evidence that they plan to use in court to the defendant and to the court. This includes any documents or witnesses that may be used in the court proceeding. This ensures that the defendant has a chance to review and understand the evidence before the hearing. If the plaintiff fails to provide evidence to the court before the hearing, the case will be dismissed. It is important for the plaintiff to understand that they must provide the evidence in the allotted time because otherwise there could be serious consequences. The plaintiff’s evidence is key in determining the outcome of the hearing. By providing all necessary evidence to the court and the defendant, the plaintiff has the best chance of presenting and validating their case in a small claims court in Washington.
