How much time do I have to file an appeal in a small claims court case?

In Florida, an appeal in a small claims court case must be filed within thirty (30) days of the final judgment. The appeal is typically filed in the same court as the original claim was filed. The filing fee for the appeal is a bit more than the original filing fee; however, if you are a party to the case, you may be eligible for a waiver of the fee if you submit a complete ‘Affidavit of Indigency’. Once an appeal is filed, a hearing will be scheduled in the higher court. This hearing will be attended by all parties involved in the original case, and the date and time will be included in an Order of Appeal. The Order of Appeal will also contain instructions for handling the case and the appeal. In order to prepare for the appeal, both parties should review the document from the original case and produce any other evidence or documents that support their case. Furthermore, the parties should also prepare arguments and defenses that may be used during the hearing. The appeal hearing will be conducted in the same manner as the original trial. This means that witnesses may be called to testify, documents may be presented as evidence, and each party will have the chance to present its case. At the end of the appeal hearing, the court will render its decision. If you are not satisfied with the court’s decision, you can appeal the decision one more time to the highest court in Florida.
