How much time do I have to file an appeal in a small claims court case?
In Maryland, you have up to thirty days to file an appeal in a small claims court case. The notice of filing a claim must be given to the clerk of the district court in the county in which the court is located. This must be done within thirty days after the judgment has been entered in the court. If you wish to appeal a small claims court judgment in Maryland, you must first file an appeal in the circuit court that heard your case. You must also submit a Notice of Appeal to the Clerk of the Circuit Court. The Notice of Appeal must be filed within thirty days of the court’s final judgment. After the Notice of Appeal is filed, the filing party then has thirty days to submit a copy of the Notice of Appeal to all other involved parties. Each party has twenty days after the other parties receive the Notice of Appeal to provide a written response. Moreover, the appellant (the party filing the appeal) has ten days to submit a copy of the Notice of Appeal to the Commissioner of Appeals. The Commissioner of Appeals must then enter the Notice of Appeal into a docket within ten days of receipt. Once the Notice of Appeal is entered on the docket, the court must set a hearing date within thirty days. Therefore, it is essential that you carefully time your notice of appeal so that you can receive a hearing date within the prescribed thirty-day period.
