How do I write an answer to a summons in a small claims court case?

If you have been served with a summons to appear in a small claims court in West Virginia, then you must provide the court with a written answer to the claims made against you. This is done by filing a written document called an “Answer” with the court. In general, your Answer should contain the contact information for you and the plaintiff, as well as a brief statement of the claims against you. After that, you must state whether you admit or deny each of the claims. If you admit one or more of the claims, you must explain why you admit them. If you deny any claims, you must provide a reason why you deny the claims and state any facts that support your denial. In addition to stating whether you deny or admit the claims made against you, you may also include affirmative defenses in your answer. Affirmative defenses are facts or legal arguments that could potentially absolve you of any responsibility for the claims. If applicable, you should list and provide a brief explanation of each affirmative defense. Once you have completed your Answer, you should file it with the court. You must also provide the other party with a copy. Finally, you must appear in court on the designated date to present your Answer and to raise any arguments or defenses that you believe should be heard by the court.
