Can I take depositions in a small claims court case?

In Colorado, you cannot take depositions in small claims court cases. A deposition is a formal questioning of a witness outside of the courtroom, and are typically used in more complex cases. Small claims court is designed to be a quick and easy way for individuals to resolve civil disputes without having to hire expensive lawyers and take the case to a more complex court system. The purpose of small claims court is to provide an informal, user-friendly, inexpensive procedure for individuals to resolve relatively small legal disputes. This means that the rules are less complicated, and the paperwork involved is also simplified. As with other types of court, individuals do have the right to present evidence, cross-examine witnesses, and make arguments, but the process is much more informal than in a more advanced court system. Additionally, small claims court hearings are designed to be much shorter than in other courts. This means that the court does not have the time or resources for depositions which are much more complicated. Thus, in a Colorado small claims court case, you cannot take depositions as part of your case.
