What happens if I cannot attend the small claims court hearing?

If you are unable to attend the Small Claims Court hearing in Virginia, you can submit a written statement explaining why you cannot appear. You should include this statement with your reply to the summons. You can also submit evidence and/or a signed statement from a witness. The court may then decide to either reschedule the hearing or move forward with a decision without you present. Your written statement and evidence presented by you or your witness will help the court make this decision. If the court decides to proceed without you, they may or may not rule in your favor. You may also request a continuance of the hearing if you cannot attend. To do this, you must submit a written request to the court explaining why you need an extension of time. The court will decide if your request is reasonable and will either grant it or deny it. The court may also allow someone to appear in your place. You will need to submit written permission from the court to allow someone else to represent you. This person will need to provide a written statement and evidence to support your case. If you miss the hearing and do not submit a written statement or provide evidence, the court may decide against you and issue a default judgment. This judgment may last up to 10 years and can limit your ability to challenge the decision at a later date.
