What are the possible outcomes of a slip and fall case?
When an individual slips and falls and is injured due to the negligence of property owner or manager, the individual may file a lawsuit against the responsible party. A slip and fall case can result in a variety of outcomes, depending on the circumstances of the incident. In California, the individual who slipped and fell may be able to receive monetary compensation for their medical bills, lost wages, pain and suffering, and other damages that the court determines to be related to the incident. The individual may also be able to receive punitive damages if the responsible party’s negligence was found to be intentional or grossly negligent. Punitive damages are separate from compensatory damages and are meant to punish the defendant for their conduct. The defendant in the case may also be subject to injunctive relief, which is a court order requiring the defendant to take certain actions or refrain from certain actions. For example, a court could order the defendant to fix a hazardous condition that led to the slip and fall. In addition to the court ordering the defendant to pay damages or to take corrective actions, the court may also find the defendant liable in the case without any need for compensation. This decision by the court will create a legal precedent in the state of California that might be of assistance to others who have suffered similar accidents in the future. Finally, a slip and fall case can be dismissed by the court if the defendant is found to not be liable for the injuries suffered. In this case, the plaintiff may not be eligible for any compensation. However, the plaintiff still has the option to re-file the case if new evidence arises.
