What is the legal definition of a “slip and fall”?
A slip and fall occurs when an individual slips, trips, or falls due to an unexpected hazard or dangerous condition. In Arizona, a slip and fall is defined as an incident in which an individual slips or trips due to an unexpected hazard or dangerous condition in a public or private place, resulting in personal injury or property damage. Examples of dangerous conditions that could potentially cause a slip and fall include a wet floor, uneven surfaces, poor lighting, objects on the ground, and defective stairs. The legal definition of a slip and fall is further defined by whether or not the property owner or occupier had notice of the dangerous condition or should have known that the condition existed and failed to take appropriate action. For example, if a clerk at a retail store spills a liquid on the floor and does not clean it up or warn customers of the hazard, the property owner or occupier would be held responsible for any slips, trips, or falls caused by the hazardous condition. In addition, a slip and fall can be considered a premises liability case if the individual can prove that the property owner had knowledge of the dangerous condition, that they didn’t act in a reasonable manner to fix or warn of the danger, and that the condition caused their injury. If the individual can prove these elements, they may be entitled to damages related to their medical bills, lost wages, and emotional distress.
