What is the legal definition of a “slip and fall”?

In Virginia, a “slip and fall” is defined as an incident caused by a dangerous condition on the property of another, resulting in an injury to one’s person or property. Slip and fall is a form of premises liability, which happens when a person is injured on another’s property due to the owner’s negligence. A slip and fall can encompass various dangerous conditions, including wet or slippery floors, poor lighting, broken stairs, or icy sidewalks. In order to prove a slip and fall incident, the injured party must be able to show that the property owner was negligent in either creating or failing to timely fix the hazardous condition. Additionally, it must be established that the owner of the property either knew or should have known about the hazardous condition and had a reasonable amount of time to address it. Furthermore, the injured person must have been acting with reasonable care and not have caused the incident him/herself. If the injury is found to be as a result of the owner’s negligence, the injured person is entitled to compensation for damages. These damages can include medical bills, lost wages, and pain and suffering. In order to recover these damages, the injured party must seek legal representation. Slip and fall cases can often be difficult to prove; therefore, it is important for anyone who has suffered an injury due to a property owner’s negligence to contact an experienced lawyer who can help them to navigate through the legal system and receive the compensation they deserve.
