How do I qualify for a loan discharge due to my disability?

In Virginia, one is eligible for student loan discharge due to disability if they meet certain criteria. The borrower must submit documentation that verifies they are “totally and permanently disabled” according to the definitions of the Social Security Administration. This documentation must come from a physician or the Department of Veterans Affairs. The borrower must also provide documentation that shows their total and permanent disability prevents them from being able to earn money to repay the loan. This may include a letter from the Social Security Administration which states the borrower’s disability status and an annual statement of income that the borrower has received from the Rehabilitation Services Administration. The borrower must also submit an application for loan discharge due to disability to their loan servicer. The loan servicer will review the application and documentation and then contact the borrower if additional information is needed. The loan servicer will then make a decision about whether to discharge the loan. If the loan servicer approves the application, they will discharge the loan and the borrower will no longer have to make payments. The borrower should contact their loan servicer to confirm that the loan has been discharged due to their disability.
