How do I appeal a Social Security Disability claim denial or termination?
In Tennessee, appealing a Social Security Disability (SSD) claim denial or termination begins with filing a Request for Reconsideration with the Social Security Administration (SSA). This request should explain why the applicant believes the denial or termination was wrong. It should also include any medical records or other evidence that supports the person’s eligibility for SSD benefits. The SSA will then review the request and make a determination. If the decision is still unfavorable, the person can then appeal the decision to an Administrative Law Judge (ALJ). This step requires filing a Request for Hearing by an Administrative Law Judge. The person should provide a copy of the Request for Reconsideration as well as any new evidence that has become available since the reconsideration request was filed. At the hearing, the ALJ will review the evidence and testimony provided by the person and the SSA. The ALJ will then issue a written decision, either affirming or reversing the SSA’s decision. If the decision is still unfavorable, the person can then appeal the decision to the Appeals Council. The Appeals Council may review the decision and issue its own ruling or return the case to the ALJ for further review. The Appeals Council may also decide to deny the case, in which case the ALJ’s decision is the final ruling. After exhausting the administrative appeals process, a person may still bring a claim for review to a federal court. It is best to seek the advice of a qualified attorney before taking this step.
