Does spousal support continue if the paying spouse gets a job after retirement?

In Wisconsin, spousal support does not necessarily continue after the paying spouse retires, depending on the specifics of the court order regarding the spousal support. If the court order specifies that the spousal support is to continue upon the paying spouse’s retirement, then the support will still be due and owing. In most cases, however, spousal support ends at the time of retirement or when the recipient of the support remarries, unless the court order explicitly indicates otherwise. If the paying spouse gets a job after retirement, that generally does not require them to continue paying spousal support and the court will not typically order that the paying spouse make additional payments. In certain special cases, however, the court may order that the paying spouse continue paying spousal support after retirement. This can be the case if the paying spouse has a significant income increase due to the new job that significantly exceeds their income prior to retirement. In such cases, the court may order the paying spouse to continue paying the same amount or an adjusted amount of spousal support as previously ordered based on the increase in income.
