Is spousal support modifiable after the divorce is finalized?

Yes, spousal support (sometimes referred to as alimony) is modifiable after a divorce is finalized in Virginia. According to the Virginia Code, if there has been a “substantial material change in the circumstances of either party” then a spousal support award can be modified. A substantial material change can include such events as a substantial increase or decrease in income, the recipient party’s remarriage, or illness that affects the parties’ ability to earn an income. In addition, spousal support is modifiable if the court finds that the current amount paid is no longer reasonable and necessary. This can include changes in the cost of living, changes in the ex-spouse’s income or way of life, or changes in the lifestyle of the recipient. Regardless, any modifications to spousal support must still be in line with the original terms of the divorce agreement and must be approved by the court. To make a modification, the requesting party must petition the court and explain why they believe a modification should be made. If the request is approved, the court will issue an order for the affected parties to follow.
