Can spousal support be terminated if the paying spouse retires?
In West Virginia, spousal support can be terminated when the paying spouse retires. According to state law, the court may modify an order to terminate support if the paying spouse has retired, is physically or mentally incapacitated, has taken a pay cut, or is no longer able to financially support the receiving spouse. The court must consider the age and physical health of both parties, the length of the marriage, the past standard of living, the financial resources of each party, and other relevant factors. If the paying spouse’s retirement is voluntary, the court must also consider if it would be fair to terminate support. When determining fairness, the court will examine the paying spouse’s previous income, their current or future retirement benefits, any Social Security benefits, and any income from investments. The court will also consider the financial needs of the receiving spouse such as medical expenses, educational expenses, or any other costs associated with a reasonable standard of living. Ultimately, the court will decide if a termination of spousal support is appropriate in light of the circumstances and relative financial situation of the parties. If the court determines that termination is in the best interests of both spouses, it will grant a motion to terminate spousal support due to the paying spouse’s retirement.
